I am a UK citizen brought up in India. I am in US now working on H1-B. Since I plan to return to India after few years for good, I decided to apply for OCI(overseas citizens of India)/dual citizenship of India.
I will have to apply for green card after few years to maintain my employee status here in USA.
Now, the question is, will I get privilege if I am UK citizen compared to dual citizen of India when I apply for US green card?
If I get any privilege(like quicker processing time, etc) I will just get a visitor's visa/PIO card of India for now.
Please advice. I am really confused. Thank you.

I had applied for 485 in July with Future Employer in EB3.
After 6 months, I want to port the application to my existing employer. At that time, is it possible to convert the application from EB3 to EB2 using AC21 portability??

Does this work as shot or does it need fill flash. Since it was about 18 degrees with a stiff breeze out of the north and my fingers and toes were frozen, I'm not sure I would have bothered with a flash, regardless, but would appreciate knowing what people think for when I shoot the same kind of shot in warmer weather. (Yes, I know I blew out the feathers on the back.)

Hi All..
I am on H1 since Oct 07. I haven't left USA so far and so I haven't gone for stamping. However, I heard that I need to go to stamping before completion of 1yr after getting H1. Is this true? and to what cases does this rule apply?
Please help. I am confused.

I don't believe leaving the company that you had signed an I-9 form with have any impact on your GC app as long as you have a same or a similar job lined up if and when you do get an RFE regarding the same.
As mentioned several times, GC is for future employment and you can switch employers as many times as you want under AC21 (of course you don't want to go overboard with switching employers every few months either :)).
I hope this helps - again this is my understanding of the law and not a legal opinion.

you bet, here is the first draft.
illegal waiting at the border = 500 points handed in a platter when you cross the border. 100 additional points per day for 6 days after you cross 50 ft beyond the border.
illegal in the country = 500 basic points + 500 bonus points + 100 points on compassionate grounds
legal + skilled = zero, nada, zilch, legal have been awarded 1 point for every month in the country on compassionate grounds
points for GC 600
points for GC via fedex and no paperwork 601 points.

take your pick... call the senators and tell them of our problems...

my husband concurently file I-140 and I-485 (along with EAD and AP) on 22nd June 2007. We got our I-140 approved on 30th August. I have two questions
1. When can i expect my EAD ?
2. Is there any rule that i shud start working within some stipulated time after getting my EAD or i can take my own time ?

I am trying to schedule a visa appointment date and VFS website doesn't show any consulate except chennai!! can somebody please let me know what should be the reason? Last week, I was able to see Mumbai and Chennai and now Mumbai is gone! Is this because no appointments dates are available or something wrong with the website. I tried using different browsers, clearing cache, etc. but no help so far. Please help me. Will really appreciate your response.

The list of applicants who must obtain an Advance Parole document before traveling outside of the United States is as follows:
� Applicants that have been granted Temporary Protected Status (TPS);
� Applicants with a pending application for adjustment of status to lawful permanent resident (LPR);
� Applicants with a pending application for relief under section 203 of the Nicaraguan Adjustment and Central American Relief Act (NACARA 203);
� Applicants with a pending asylum application; or
� Applicants with a pending application for legalization

I though it would be a good idea to start consolidating all the RFE's, so that people would have one thread to look at if at all there is any RFE
Note: If there is already a thread, admins please delete this thread
1. RFE on current employment and offer of proposed employment (description of position) and offered salary
2. Current address proof
3. Missing G325-A need to submit one (but I did send them initially)
4. Evidence that you maintained non immigrant status from the date of first entry till the date you filed your I 485

While quoting, discussing such links helps the members of this forum somewhat in keeping the buzz, I feel we must have focussed efforts on specific provisions that will improve the issues faced by legal immigrants. It is possible that this is easier to achieve than a Comprehensive Immigration Reform that this articles speaks about. Thanks to apnair2002 for the post.

from Employer "B" if i fall in the other Category which is Labor being filed

I have started a new thread to remind everyone (who has not yet contributed) to contribute for the just concluded Advocacy day.
Take some funds from any money that you put aside this year for charitable causes or temple donations. All that you contribute is money well spent - as eventually it would benefit a number of people and entire families. So helping people better their lives is like contributing to charitable causes. Even $50 is good to start with. Hope that motivates all.

I worked with company A for 6 months and then transferred H1B to new company B with whom I worked for 1.5 years. Meanwhile company A did not cancel my H1B and now when I am thinking of joining company A. Can we use older H1B petition. Is it ok to use older H1B petition or should we cancel older H1B on file and file new H1B transfer?
